Plant Breeder’s Rights

GRIP has the experienced and qualified personnel to apply for registration of Plant Breeder’s Rights (“PBR”). This is an important fully comprehensive service that covers all aspects of the PBR application process from the initial lodgement of the PBR application, the provision of the Qualified Person (“QP”) registered with the PBR authority, the provision of growing trial management (if that is required), through to the coordination of the application process required to achieve registration.

Assistance with the management of international plant variety rights and patent protection application is available if warranted.

Plant Variety Management 

GRIP can offer a range of services relative to assisting you with the development and management of your plant variety intellectual property. These services can be provided as a comprehensive ‘package’ or more aligned to some of the individual service components that may be customised to best accommodate your requirements.

These offered plant variety management services include the following components:

Trademark Management
Many plant varieties are selected for marketing under strategic trademark arrangements and programs and we can assist with the development and management of trademark programs.  We can suggest appropriate legal firms for the formal trade mark applications and / or licensing contractual arrangements (if required) or you can use a preferred legal advisor for this purpose. We are happy to work with the legal advisor that you ultimately prefer.  

Licensing & Contract Negotiation
As a variety breeder or owner, GRIP can assist you with the negotiation and on-going management of the licensing of your plant varieties in line with your overall legal, marketing and distribution plans.  This can include the licensing of your plant variety to nurseries, propagators, marketing entities and other third parties in the supply chain of your marketing and distribution plan.

As a prospective licensee of a plant variety, GRIP can assist you with negotiating for the appropriate rights in the plant variety with the breeder, owner or authorised rights holder of that variety.

GRIP personnel are experienced in negotiating both domestic and international plant variety licensing and in the overall management of such variety licensing.  We have the ability to explore foreign marketing opportunities for your plant varieties with our associates located in the major developed growing and marketing regions around the world.  

Royalty Collection programs:
GRIP can assist with the management of all aspects of royalty collection and reporting ‘stream’ emanating from plant variety licensing arrangements and marketing plans and these can include collection of royalties such as a per plant sold royalty, per hectare annual royalty or a production based royalty for the likes of fruit production from licensed plants, or an alternative royalty / licensing structure more suited to your variety and marketing plans and strategies.
